L'Avvocato Francesco Cinquemani, alias "lo squalo", disintegra la sentenza n. 199/2025 della Corte Costituzionale, quella che definisce legittimi gli obblighi vaccinali in "pandemia" Cerchiamo di sintetizzare in cinque punti cosa si contesta alla sentenza della Corte Costituzionale nel magistrale articolo dell' Avv. Cinquemani, vero fuoriclasse, che si distingue per rigore tecnico-giuridico e precisione chirurgica nello smontare la pronuncia. 1. Ha evitato il nodo centrale: "vaccini" non autorizzati per prevenire l'infezione - La Corte Costituzionale, anche chiamata Consulta, ignora che il D.L. 44/2021 imponeva l'obbligo per "prevenire l'infezione", ma i "vaccini" non erano autorizzati a farlo. Questa contraddizione è il "vizio originario" che la Consulta si rifiuta di affrontare. 2. Deferenza cieca alle autorità sanitarie - rinuncia al controllo La Corte accetta senza verificare le affermazioni delle autorità, quando le stesse nel 2021 ammettevano: -Nessun dato sulla trasmissione -Studi incompleti su anziani e fragili -Autorizzazione solo condizionata La Consulta ha rinunciato al suo ruolo di garante dei diritti fondamentali, abdicando al controllo di proporzionalità. 3. Ignora l'utilizzo off-label di massa (illegale) Utilizzare un farmaco off-label, vuol dire che lo stesso è prescritto al di fuori delle indicazioni approvate nell'RCP/bugiardino. Se il "vaccino" è autorizzato per la malattia ma imposto per l'infezione, è uso off-label, che richiede: -Valutazione AIFA specifica -Consenso informato rafforzato -Monitoraggio rigoroso -Responsabilità del medico che somministra il farmaco Nulla di tutto ciò è stato fatto. La Corte non risponde nemmeno una riga su questo punto sollevato da altri tribunali. 4. Proporzionalità e dignità: i grandi assenti nella sentenza 199/2025 L'art. 32 della Costituzione impone tre condizioni per i trattamenti sanitari obbligatori: -Tutela della salute individuale -Tutela della salute collettiva -Rispetto della persona umana La sospensione dal lavoro, privando di retribuzione la persona, è stata qualificata da numerosi giudici come: -Discriminatoria -Lesiva della dignità -Devastante economicamente -Sproporzionata La Consulta per questo punto rifiuta ogni valutazione ex post, cristallizza la legittimità della norma al momento della sua emanazione, ignora che già nel 2021 i dati erano insufficienti. 5. Una sola sentenza non crea diritto vivente L'accusa più dura, abrasiva, feroce: pretendere che questa pronuncia chiuda il dibattito è giuridicamente scorretto. Una singola sentenza non può ribaltare i principi costituzionali fondamentali. Quando la Corte Costituzionale diventa incostituzionale Con la sentenza sull'obbligo vaccinale, i giudici costituzionali hanno prodotto una delle più gravi distorsioni interpretative della storia repubblicana, stravolgendo l'articolo 32 della Costituzione fino a renderlo irriconoscibile. Art. 32: Nessuno può essere obbligato a un determinato trattamento sanitario se non per disposizione di legge. La legge non può in nessun caso violare i limiti imposti dal rispetto della persona umana. L'assurdità è manifesta fino ad diventare un ossimoro: la Corte ammette che il "vaccino" non impediva la trasmissione del "virus", ma sostiene che l'obbligo sia comunque legittimo per "ridurre il carico ospedaliero". Oltretutto, ci sono ormai migliaia di casi documentati di danni prodotti da questi sieri, per alcuni di questi sono state emesse anche sentenze dove si parla di chiara correlazione vaccino-patologia. Altra architrave che crolla: non erano né efficaci né sicuri. A fronte di questi presupposti, con quale logica costituzionale si può imporre coattivamente un trattamento a chicchessia? La risposta della Corte è agghiacciante: basta un generico "interesse pubblico". La Corte ha di fatto riscritto l'articolo 32, trasformando un diritto fondamentale con limiti rigorosissimi in una norma manipolabile a piacimento del legislatore. La motivazione è giuridicamente insostenibile. Nessun costituzionalista serio può accettare che un obbligo sanitario si giustifichi con mere esigenze organizzative del sistema ospedaliero, senza alcun nesso con la prevenzione della diffusione della malattia. È una torsione interpretativa che fa violenza al testo costituzionale. Questa sentenza puzza di subordinazione politica. Non c'è altra spiegazione per un'acrobazia argomentativa così forzata, così palesemente contraria ai principi consolidati. I giudici costituzionali sembrano aver abdicato al loro ruolo di custodi della Costituzione per assecondare scelte politiche che nulla hanno a che fare con la salute dei cittadini. La domanda è inevitabile: a quali interessi risponde questa sentenza? Perché stravolgere decenni di giurisprudenza proprio su questo tema? Perché piegare ed insultare la Costituzione invece di difenderla? La Corte Costituzionale doveva essere l'ultimo baluardo dei diritti fondamentali.
