  • Luglio 2020, nel silenzio mediatico, complice l' arrogante, pervasiva e menzognera narrazione pandemica, alla Camera dei Deputati si teneva una conferenza stampa voluta dall' allora deputata Veronica Giannone alla quale invitò l' avvocato Domenico Morace e la sua assistita, una mamma a cui vennero tolti i suoi quattro figli. Una vicenda risalente all' anno 2018 quando l' assistita veniva a conoscenza, dai figli stessi, che il loro padre, che già da qualche mese si era separato e viveva in una propria casa, aveva fatto oggetto una delle due figlie, all' epoca poco più che dodicenne, di attenzioni di natura sessuale, che in un primo momento confessò essere veritiere.
    Una vicenda ben diversa dai fatti altrettanto incresciosi di questi giorni, che si spera di tutto cuore non procurino danni ai bambini allontanati dai loro genitori per disposizione dei soliti tribunali dei minori, istituzioni che da qualche tempo a motivo di uno spropositato zelo ( eufemismo) posto in essere da assistenti sociali e consulenti psichiatri ( vorrei tanto sperare si trattasse di uno sparuto numero ) si sta guadagnando, ahimè comprensibilmente, la riprovazione di tanti cittadini.
    Non mi dilungo oltremodo, salvo aggiungere che le affermazioni della deputata e dell' avvocato denunciano un sistema che se non è da ritenere malato vi sono sicuramente dei vulnus, per usare le espressioni udite, nella nostra struttura che dovrebbe sovraintendere a tutela delle fasce deboli. Quelle situazioni familiari ove vi siano evidenti e oggettivi atti che compromettono la salute fisica e/o psicologica dei minori giustificano i provvedimenti, temporanei o definitivi, di un affidamento di essi alle strutture preposte e ricercando nel contempo, se possibile, le soluzioni per ripristinare l' unione del nucleo familiare.
    Oggigiorno per " ragioni futili o non giustificabili come la povertà, questioni sociali o addirittura per costrutti giuridici come l' alienazione parentale " i tribunali decretano la sospensione genitoriale ( concetto che ha soppiantato quello della patria potestà in forza del decreto legislativo n° 154 del 2013); sentenze rientranti nell' ambito del codice civile che non prevede, a differenza del penale, l' obbligatorietà di ascoltare anche i minori. Ricorda l' avvocato Domenico Morace che c'è stata una sentenza di Cassazione Civile che dice che non costituisce alcun illecito, alcun atto illegittimo da parte di un giudice che deleghi l' ascolto dei testimoni non maggiorenni esclusivamente ai periti, ossia ai soli assistenti sociali e psichiatri, cosicché, conclude l' avvocato, accade che il tribunale dei minori emette la ( esiziale) sentenza senza aver mai né visto né ascoltato la versione dei minori, diversamente da quello che impone la procedura dell' ambito penale.
