E' un risvolto quantomai particolare quello che l'avv. Mauro Sandri ha promesso in queste ore di rendere pubblico non appena sarà possibile avere i verbali della seduta. La prima udienza si è svolta nei giorni scorsi. La dottoressa bolognese è stata radiata dall’Ordine dei medici di Venezia nel 2022 per le sue posizioni sulla gestione della pandemia da Covid. La Balanzoni è ora imputata per diffamazione e minacce a seguito di una querela sporta nel marzo 2022 da Filippo Anelli, presidente dell’Ordine dei medici di Bari e della Fnomceo (Federazione nazionale Ordini dei medici chirurghi e odontoiatri). Durante l’udienza, tenutasi davanti al giudice Fabio Cosentino, Anelli ha testimoniato in merito a due video pubblicati dalla Balanzoni su YouTube a gennaio e febbraio 2022, successivamente oscurati. Anelli ha dichiarato di aver provato un profondo disagio a causa di questi video e di essere stato costretto a cambiare abitudini e a richiedere l’intervento della polizia "per il clima di odio contro gli Ordini che si era scatenato" in quel periodo. La difesa dell’imputata sostiene che Anelli non avrebbe fornito “chiare precisazioni su quali sarebbero le frasi diffamatorie e minacciose che gli sarebbero state rivolte” e che la Fnomceo avrebbe agito in violazione di legge, mentre la Balanzoni avrebbe semplicemente esercitato il suo diritto di critica. Un autogol, secondo Sandri E in effetti, secondo le ricostruzioni di Sandri, nemmeno Anelli avrebbe saputo far cenno alla legge secondo cui ha querelato Balanzoni: "Quest'ultimo ha rilasciato dichiarazioni quanto meno opinabili affermando di 'avere eseguito la legge', ma al contempo non ha saputo rispondere alla domanda di quale fosse il contenuto della legge alla quale ritiene di avere adempiuto... Dopo avere detto di essersi sentito minacciato tanto da dover ricorrere a "protezioni", ha ripetutamente affermato di non ricordare i fatti specifici che ha posto a fondamento della sua denuncia. Un comportamento tra il reticente ed il surreale". E' solo l'inizio di una controffensiva di legalità che travolgerà i falsari della pandemia". La dottoressa ha commentato: “Era giunto il momento di affrontare questa cosa per chiarire a livello giudiziario. Io ho dovuto perdere la mia vita, il mio lavoro (sono stata sospesa, radiata e ho perso la copertura assicurativa) e ho dovuto cambiare città e regione”. In aula il presidente dell’ordine dei medici "ha continuato a dire che a lui interessava una sola cosa, cioè che i medici avessero il certificato vaccinale a posto, cioè lui era un esecutore della legge", riporta Balanzoni. "A un certo punto Sandri ha chiesto: quali erano questi vaccini autorizzati? E lui ha detto, non mi interessava quale fosse il vaccino autorizzato, cioè fatene uno, fatene un altro, cioè tu dovevi avere il vaccino o non potevi esercitare, e perché quello era un requisito di legge a cui io dovevo temperare per il ruolo istituzionale". Il silenzio dell’Ordine: quando il confronto tra medici diventa un tabù In un’epoca in cui la medicina dovrebbe essere guidata dal confronto, dalla scienza empirica e dall’etica, ciò che più ha colpito negli ultimi cinque anni è stata l’assenza di umanità. Il confronto tra medici, pilastro fondamentale della crescita professionale e scientifica, è stato sistematicamente ostacolato, quando non punito. Eppure, solo dal dialogo, anche tra visioni diverse, possono nascere progresso, consapevolezza e tutela della salute dei pazienti. Avremmo voluto rivolgere delle domande al Dr. Filippo Anelli, Presidente della FNOMCeO, per ascoltare la sua versione sulla gestione degli Ordini dei Medici in questi ultimi anni. Ma l’unica risposta arrivata è stata quella dell’ufficio stampa: “Il Presidente non può al momento rispondere all’intervista”. Un silenzio che pesa, che allarma, e che lascia spazio a interrogativi legittimi. Negli ultimi cinque anni, migliaia di medici in Italia hanno subito procedimenti disciplinari che sembrano avere una matrice più politica che deontologica. I casi emblematici, come quello del Dr. Giuseppe Barbaro, mostrano come il semplice esercizio critico della professione sia stato spesso sanzionato, non sulla base di errori clinici, ma per l’interpretazione politica del Codice Deontologico. Il riferimento va in particolare all’art. 4 relativo alla libertà ed indipendenza del medico e dell’art. 58 del Codice, che regola i rapporti tra colleghi, invitando al rispetto delle competenze e alla possibilità del dissenso. Invece, in molti casi, è bastata una prescrizione non allineata al pensiero dominante, una diagnosi attenta alla singola storia clinica del paziente, l’invito alla prudenza, per far scattare procedimenti sanzionatori. Tutto questo in aperta violazione anche dell’art. 13, che tutela il diritto del paziente a essere informato in modo completo e veritiero, degli art. 15, 22 e 23 che dovrebbero garantire le cure precoci e la continuità di cura con farmaci efficaci, e degli articoli 45 e 48, che trattano in modo specifico i farmaci genici e sperimentali, imponendo rigore e valutazione caso per caso. Soprattutto in merito alla gestione terapeutica del Covid-19, il dibattito è stato schiacciato da una narrazione univoca. Parlare di “vaccino sicuro ed efficace” senza confronto sui dati reali, quando la scheda tecnica ha subito 18 revisioni e lo stesso farmaco era in fase sperimentale, è apparso non solo riduttivo ma irrispettoso verso il metodo scientifico. Allo stesso modo, l’imposizione della “tachipirina e vigile attesa” come linea guida, anziché come opzione, ha escluso ogni possibilità di ricorso alle terapie domiciliari precoci, molte delle quali si sono rivelate clinicamente efficaci e per le quali molte persone hanno avuto salva la propria vita. Il vero nodo è deontologico: rifiutare il confronto tra colleghi, in virtù delle norme citate, è già una violazione dei principi che regolano la professione. Invece è stato permesso ad opinionisti “tele-virologi”, di monopolizzare l’informazione medica, senza contraddittorio, mentre i medici che portavano dati clinici venivano zittiti e, molti di loro invece radiati. Nel resto del mondo, oggi, molte istituzioni sanitarie stanno facendo autocritica. In Italia, invece, il dibattito è ancora bloccato, e il vertice dell’Ordine dei Medici continua a sottrarsi al confronto. Eppure, è proprio nei momenti di crisi che emerge il vero valore della professione medica: la capacità di ascoltare, di discutere, di rimettere al centro la scienza, ma soprattutto l’essere umano.
